1.3 These Terms apply exclusively. Any conflicting, deviating, or supplementary terms and conditions proposed by the Customer shall not become part of the contract unless expressly agreed to in writing by the Provider.
2. Subject Matter of the Service
2.1 The Provider offers professional, scheduled on-site shower enclosure installation services for residential and eligible properties across Europe.
2.2 The service encompasses the physical assembly, alignment, sealing, and mounting of shower enclosures based on the specifications provided during the booking process and verified on-site by qualified installation personnel.
3. Booking Process and Deposit Mechanism
3.1 Booking Deposit Only:
All prices displayed on our website represent a booking deposit (Deposit) only and do not constitute the total price for the shower enclosure installation service.
3.2 Purpose of the Deposit:
The payment of the deposit serves to confirm the Customer’s booking intent, secure the appointment schedule, and initiate the pre-service verification process.
3.3 Final Pricing Determination:
Shower enclosure installation is subject to project-specific variables, including exact on-site dimensions, wall and floor conditions, existing plumbing layouts, product specifications, and structural installation complexity.
Consequently, the full and final service cost is determined following professional verification of site conditions and service requirements.
Any additional charges or adjustments to the scope of work will be communicated to the Customer and agreed upon prior to the commencement of any physical work.
4. Customer Obligations and Site Preparation
4.1 The Customer is required to provide accurate, truthful, and complete information regarding the installation site, product specifications, and spatial dimensions when submitting a booking request.
4.2 The Customer must ensure safe, unobstructed access to the installation area and ensure that all necessary utilities (such as water shut-off valves and electricity) are accessible and in proper working order.
4.3 If actual site conditions differ substantially from the information provided during the booking process—potentially impacting the scope of work, safety, or duration—the Provider reserves the right to re-evaluate the service arrangements in consultation with the Customer before proceeding.
5. Pricing, Payment, and Settlement
5.1 Payments processed via the website are strictly for the booking deposit amount.
5.2 Accepted payment methods are displayed during the secure online checkout process. All transactions are encrypted and processed securely.
5.3 The remaining balance or settlement for the final installation service cost will be invoiced and settled in accordance with the specific service agreement or order documentation established after site verification.
6. Statutory Right of Withdrawal for Consumers
6.1 Application of Withdrawal Rights:
If the Customer acts as a consumer within the meaning of applicable European and German consumer protection laws (specifically Section 13 of the German Civil Code – BGB), the Customer is entitled to a statutory right of withdrawal when concluding distance service contracts.
6.2 Withdrawal Period:
The statutory withdrawal period is 14 days from the day of the conclusion of the contract, without the need to provide any justification.
6.3 Exercise of Withdrawal:
To exercise the right of withdrawal, the Customer must inform us (Lokalleadsgmbh, Email: installation@lokalleadsgmbh.com) of their clear decision to withdraw from the contract by means of an unequivocal statement.
6.4 Premature Expiry of the Right of Withdrawal for Services:
Pursuant to statutory provisions under European and German law, the right of withdrawal for service contracts shall prematurely expire if the Provider has performed the service in full and has only begun performance after the consumer has:
Expressly consented to the Provider commencing the performance of the service before the expiration of the withdrawal period; and
Confirmed their acknowledgement that they lose their right of withdrawal upon complete contract performance by the Provider.
If a consumer requests that the installation service commence during the 14-day withdrawal period, the consumer shall pay an amount in proportion to the services provided up to the time they communicate their withdrawal, relative to the full coverage of the contract.
7. Cancellation and Deposit Refund Policy
7.1 If a booking is canceled by the Customer prior to the dispatch of technicians or before site verification—and in compliance with applicable statutory withdrawal periods—the booking deposit is fully refundable.
7.2 If an on-site installation appointment cannot be executed due to inaccurate information provided by the Customer or insurmountable site unsuitability identified upon arrival, the deposit may be subject to a deduction covering administrative and logistical dispatch efforts, to the extent permitted by applicable law.
8. Liability and Warranty
8.1 The Provider shall be liable without limitation for damages resulting from injury to life, limb, or health caused by a negligent breach of duty by the Provider or an intentional or negligent breach of duty by a legal representative or vicarious agent of the Provider.
8.2 For other damages, the Provider’s liability is limited to typical and foreseeable damages arising from ordinary contractual breaches, except in cases of intent or gross negligence.
8.3 The Provider assumes no liability for structural defects, hidden plumbing or electrical hazards within the Customer’s property, or discrepancies arising from incorrect measurements or specifications supplied directly by the Customer.
8.4 Statutory warranty rights (Gewährleistung) under German civil law apply to the installation services provided.
9. Applicable Law and Jurisdiction
9.1 These Terms and all legal relationships between the Provider and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), without prejudice to mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
9.2 If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered seat of the Provider in Germany.
10. Final Provisions
10.1 Should any individual provision of these Terms be or become invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic intent of the original provision.
